Horák & Chvosta represented KORD Group in insolvency proceedings

H&C team has successfully represented four member companies of KORD Group (KORDÁRNA, a.s., KORDSERVICE SK, a.s, SLOVKORD, akciová spoločnosť and Slovenský hodváb, a.s.) throughout the insolvency proceedings which has received a substantial media coverage.

Cross-border insolvency proceedings in which insolvency of each debtor is being solved through reorganization operate not only pursuant Czech Insolvency Act but in accordance with Council Regulation (EC) No. 1346/2000 on insolvency proceedings. This Council Regulation sets the obligation to hold the insolvency proceedings in the EU Member State where the debtor conducts his business as the centre of his main interests (COMI).

H&C’s attorneys have provided KORD Group companies with complex legal services incl. preparation of respective reorganization plans and have successfully completed the insolvency proceedings by receiving approvals of all four reorganizations plans at the creditors’ meetings.
